Deborah Eckland and Dan Singel represented the general contractor in Boegeman v. Juergens Constr., Inc. (Scott County District Court, 2006). Boegeman claimed his home was riddled with construction defects, water intrusion, and mold. His damages claim was in excess of $400,000.

Boegeman was consistently unreasonable in his settlement demands, so we settled all but one of our derivative claims with the subcontractors and proceeded to trial. We presented evidence that the home was acceptably built, and we made clear that our client was ready and willing to pay for the nominal cost to remediate the inconsequential mold growing in the home. To help prove our defense, we convinced the court to bus all the jurors to Boegeman’s home so they could see our client’s quality workmanship for themselves.

The jury awarded Boegeman just $22,000, which was less than our offer of judgment, so Boegeman ended up owing our client when all was said and done.
