Deborah Eckland and Alan King represented Liz Johnson in a whistleblower case against Northland Learning Center in Virginia, Minnesota. After a week-long trial, the jury returned a verdict in favor of Ms. Johnson and awarded damages.

We achieved an important victory for our clients, six Muslim clerics arrested at the Minneapolis/St. Paul International Airport, when a United States District Court Judge denied the motions of the defendant law enforcement officers to have the case dismissed. In a thorough and scholarly opinion, the Honorable Ann D. Montgomery agreed with our arguments that the officers were not entitled to immunity and that they still could be held liable for constitutional violations despite a recent federal law affording qualified immunity to officers responding to security issues at airports. Judge Montgomery ruled that the actions of the imams prior to their flight did not justify their detention. She noted that the imams were subjected to “extreme fear and humiliation of being falsely identified as dangerous terrorists.” Rejecting the officers argument that the attacks of September 11, 2001 justify a massive curtailment of liberty whenever the specter of terrorism is raised, the Court ruled:
“Unquestionably the events of 9/11 changed the calculus in the balance American society chooses to make, especially in airport settings, between liberty and security. Ultimately, the proper balance will be achieved, in large part, because we have the most capable and diligent law enforcement and intelligence communities in the world. But when a law enforcement officer exercises the power of the Sovereign over its citizens, she or he has a responsibility to operate within the bounds of the Constitution and cannot raise the specter of 9/11 as an absolute exception to that responsibility.”
The ruling has national importance as it protects not only the rights of the Six Imams but the entire flying public. A link to one of the news articles about the ruling including analysis by Frederick Goetz is below.
